1. Purpose of the general conditions

The present General Conditions will expressly regulate the relations arisen between IGLOO ENTERPRISE, S.L. (official distributor authorized for the commercialization of its products PEDRO GOMEZ MADRID, with address in Calle Molino de Viento, 20, 28004 MADRID – SPAIN, and CIF. B88096417, (on behalf of PEDRO GOMEZ MADRID), and third parties (hereinafter, “Users”) who register as users and / or purchase products through the online store of the website, hereinafter the “store”.

PEDRO GOMEZ MADRID reserves the right to unilaterally modify each and every one of the obligations set forth in these GENERAL CONDITIONS, without prior notice. It also reserves the right to restructure, modify or delete any information, service or content included in this website without prior notice.


2. User rights and obligations

The User is obliged, in general, to use the Store, to acquire the Products and to use each of the services of the Store diligently, in accordance with the law, morality, public order and the provisions of these General Conditions, and must also refrain from using them in any way that may prevent, damage or impair the normal operation and enjoyment of the Store by the Users or that could damage or cause damage to the property and rights of PEDRO GOMEZ MADRID, its suppliers, Users or in general any third party.


3. Conditions of sale

The price that appears indicated at all times next to the product includes VAT but does not include handling and shipping costs. PEDRO GOMEZ MADRID reserves the right to modify this price without prior notice, as well as the elimination or introduction of any element of its product catalog.

Handling and shipping costs will be borne by the customer, except for purchases over 100 € to peninsular national territory and will be specified and itemized in the invoice. The products purchased must be paid after placing the ORDER by any of the selected payment methods that will be detailed in the purchase process, according to the payment conditions of each customer.

The shipping costs do not include customs clearance or the expenses originated by these, as well as customs duties or other taxes, and the customer himself will be responsible for paying these costs if they are necessary for the reception of the goods.

The delivery time will be from 1 to 5 working days in the Peninsula since PEDRO GOMEZ MADRID receives the amount of the order. For orders to Ceuta, Melilla, Balearic Islands, Canary Islands or other international countries, it will depend on the specific delivery time of the courier company. Each delivery time is indicative in the purchase process and may depend on the selected shipping method, which will also be displayed and explained in the purchase process.

PEDRO GOMEZ MADRID reserves the right to cancel all or part of the orders unilaterally refunding the amount paid by the customer, except for the costs incurred in the ordering process. In the event that the goods have been shipped, the user will have to pay for the entire order. The dispatch of an order to its destination will generate a numbered delivery note from the transport company, which the customer must collect together with the order, being able to verify that the goods that make up the order is correct and that it is delivered in perfect condition, since the signature of the delivery note implies the waiver of any subsequent claim regarding the goods received. At the same time an invoice will be generated for the amount of the order, which will be sent on paper to the customer along with the goods, or by the means that had been agreed with the customer. The guarantee of the products is the one established by the manufacturer, being this one in any case, the responsible for the possible faults or defects that could have the supplied products, as well as of the possible consequences of the use of the same ones.

The customer is bound by the terms and conditions specified in the manufacturer’s warranty. The warranty applies as long as the product is used under normal operating conditions determined by the manufacturer, not contemplating a use other than that established in the warranty, declining PEDRO GOMEZ MADRID in any case the liability arising from the use of the same, not being obliged to compensate the user or third parties for the consequences of the use of the product, whether direct or indirect damage, accidents suffered by persons, damage to property outside the product, loss of profit or loss of profit, damage arising from deterioration, etc. ….

– Conditions for custom-made garment manufacturing orders

Variations in manufacturing processes, your monitor settings and computer hardware may affect the projection of fabrics and product designs, which means that products delivered may differ slightly in appearance from those shown and described on the website.

All products and fabrics are subject to availability, which means that we may not always be able to deliver your order within the usual lead time of 3 to 6 months. If the delay is more than the stipulated deadline, we will contact you to inform you and give you the option of a refund, a new delivery date or an alternative product to the one missing at that time. Delay over this deadline will not imply cancellation or refund, nor will it give rise to any compensation when the delay is less than 30 working days.

Please note that we will only process your order if the order has been successfully placed and we receive authorization for full payment of the total amount of the custom order.

Once the order has been placed, it is not possible to cancel an order, as production will have started and non-recoverable costs will have been incurred (fabrics, tailor’s time, etc.), thus and in accordance with art. 16 c), of the DIRECTIVE 2011/83/EU of 25 October 2011 on consumer rights, garments made to consumer specifications or clearly personalized, no cancellation of the order is allowed.

4. Returns

For returns the customer has a period of 14 days from receipt of the order, taking advantage of the right of withdrawal. If the return is due to a defect in the purchased item, PEDRO GOMEZ MADRID takes charge of the shipping and the customer has the option to be refunded the money or change the product.

If the return is due to a change of taste, size, color or any reason not attributable to PEDRO GOMEZ MADRID, the customer will be responsible for the shipping costs. Personalized items, made to order, do not admit exchange or return for the reasons mentioned in this paragraph, unless they have a manufacturing defect. PEDRO GOMEZ MADRID reserves the right to refuse returns communicated or sent after the deadline, or garments that are not in the same condition in which they were sent.

To make a return or change of size or model the customer must send the garment in perfect condition and with the original labels not removed from the garment, including the documents attached with the merchandise. In the delivery note you will have to specify if it is a return, a size change or a model change. In the latter cases you must specify the size or model you want to change. If you want the money back, you have to indicate in the same delivery note a national bank account number where you want the payment to be made. All this must be sent to the following address:

Upon receipt of the garment, we will proceed to send the new garment requested. Depending on the amount of the new garment to be sent, the company will previously inform the customer if he/she must pay the corresponding shipping cost. And in case of return, the money will be fully refunded through the same means of payment with which the customer paid, excluding the costs generated by the preparation and shipping.
